According to the Regulation on Insurance Agencies:

Real Person Agencies

(ARTICLE 4)

(1) Individuals who will engage in agency activities must meet the following qualifications:

a) Must hold the title of technical personnel.

b) Must be a resident of Turkey.

c) Must not have been sentenced to imprisonment exceeding five years for any intentional crime, even if pardoned, or sentenced to imprisonment or multiple judicial fines for actions contrary to insurance regulations; and must not have been convicted of crimes against the security of the state, the constitutional order and its functioning, national defense, state secrets, espionage, embezzlement, bribery, theft, fraud, forgery, abuse of trust, fraudulent bankruptcy, bid rigging, rigging of fulfillment of an obligation, obstruction or alteration of an information system, misuse of bank or credit cards, laundering of assets derived from crime, financing of terrorism, smuggling, tax evasion, or unlawful acquisition of property.

ç) Must meet the minimum asset requirement specified in Article 9.

d) There must be sufficient facilities in terms of physical conditions, technical and administrative infrastructure, and human resources.

e) Must complete the education levels specified in Annex-1 and the corresponding required professional experience periods.

Legal Entity Agencies

(ARTICLE 5)

(1) Legal entities intending to conduct agency activities must meet the following qualifications:

a) Must have their headquarters in Turkey and be established as either a joint-stock or limited company.

b) Must fulfill the minimum paid-up capital requirement.

c) Must possess adequate facilities in terms of physical conditions, technical and administrative infrastructure, and human resources.

(4) The real person partners of legal entity agencies, as well as the real person partners of their corporate shareholders, must meet the qualifications outlined in Article 4, paragraph (1), subparagraph (c).

Technical Personnel

(ARTICLE 6)

(1) Agencies must only have their technical personnel market, inform, and sell insurance products.

(2) To obtain the title of technical personnel, the following conditions must be met:

a) Possession of legal capacity to exercise civil rights.

b) No convictions or penalties related to the crimes listed in Article 4, paragraph (1), subparagraph (c).

c) Completing the education levels and professional experience periods specified in Annex-1.

ç) Passing the technical personnel qualification exam conducted by SEGEM.

(3) Technical personnel and the agencies they are affiliated with are responsible for damages caused to third parties arising from professional activities conducted by the technical personnel.
